Em novembro de 2023, um caso ganhou notoriedade nos meios de comunicação e redes sociais do Brasil: na condição de juíza substituta na Vara Trabalhista da cidade de Xanxerê, Santa Catarina, a magistrada Kismara Brustolin, durante uma audiência online, adotou uma postura agressiva com uma testemunha que fora convocada a prestar depoimento em uma audiência de ação trabalhista. O vídeo da audiência foi publicado e ganhou rapidamente a atenção do público devido à maneira como o depoente fora tratado pela magistrada. Neste artigo, será realizada a análise da fala da referida juíza, estabelecida nas teorias linguísticas da Pragmática, de modo especial, na categoria da Polidez e (im)polidez do discurso, tendo como objetivo geral examinar a fala da magistrada mediante a Teoria da Polidez e dos Atos de Fala. Ademais, tem como objetivos específicos: i) compreender a Teoria da Polidez e suas aplicações; ii) analisar as falas da juíza a partir da interpretação da teoria da polidez e suas categorias; iii) identificar as estratégias comunicacionais da magistrada em sua atuação no caso citado. Para tal propósito, este estudo apoia-se nas teorias de Polidez e (im)polidez de Brown e Levinson (1987), de modo especial, nos conceitos Polidez Negativa e Positiva (Aguiar, 2017), Barreto e Filho (2019); na teoria dos Atos de fala com a categoria de “Força Ilocutória”, de Austin (1990), bem como no Princípio da Cooperação (PCO), de Grice (1982).
In November 2023, a case gained notoriety in the media and social networks in Brazil: as a substitute judge at the Labor Court in the city of Xanxerê, Santa Catarina, magistrate Kismara Brustolin, during an online hearing, adopted an aggressive stance towards a witness who had been called to testify at a labor action hearing. The video of the hearing was published and quickly gained public attention due to the way the deponent was treated by the judge. In this article, an analysis of the judge’s speech will be carried out and established on the linguistic theories of Pragmatics, especially in the category of Politeness and (im)politeness of speech, with the general objective of examining the judge’s speech through the Theory of Politeness and Acts of Speech. Furthermore, its specific objectives are: i) to understand the Politeness Theory and its applications; ii) analyze the judge’s speeches based on the interpretation of the politeness theory and its categories; iii) identify the magistrate’s commu-nication strategies in her work in the aforementioned case. For this purpose, this study is based on the Politeness and (im)politeness theories of Brown and Levinson (1987), in particular, on the concepts of Negative and Positive Politeness (Aguiar, 2017), Barreto and Filho (2019); in the theory of Speech Acts with the category of “Illocutionary Force”, by Austin (1990), as well as in the Principle of Cooperation (PCO), by Grice (1982).
