É possível explicar as deficiências do Sistema de Justiça brasileiro, em especial a suposta irracionalidade e imprevisibilidade de suas decisões a partir da cultura do patrimonialismo e do personalismo característicos do “homem cordial”? O presente artigo investiga essa questão tendo como hipótese o seu desacerto. Problematizando a comparação entre a gênese do capitalismo moderno, assentado na ética protestante, e a experiência social, política e econômica brasileira, assentada em relações personalistas e patrimonialistas, o artigo argumenta que a desigualdade estrutural e a condição de subcidadania da modernização brasileira periférica seletiva são a causa das deficiências do Sistema de Justiça.
Is it possible to explain the problems of the Brazilian justice system, es-pecially the supposed irrationality and unpredictability of its decisions, based on the culture of patrimonialism and personalism characteristic of the “cordial man”? This article investigates this question. It hypothesizes that it is flawed. Questioning the comparison between the genesis of modern capitalism, based on Protestant ethics, and the Brazilian social, political, and economic experience, based on personalist and patrimo-nialist relations, the article argues that structural inequality and the condi-tion of sub-citizenship in Brazil’s selective peripheral modernization are the cause of the justice system’s problems
