O presente trabalho visa analisar a atual situação do sistema penitenciário brasileiro, bem como a violação dos direitos fundamentais dos apenados. A legislação penal brasileira é considerada exemplar por alguns países, no entanto, ao analisar a atual situação do sistema prisional brasileiro, observa-se grave desrespeito a direitos assegurados pela Constituição Federal. Nesse sentido, diante da atual situação, entende-se a necessidade do fomento a educação como uma das atitudes a ser tomada por parte do Estado, visando a diminuir a população carcerária. Na abordagem, foi utilizado o método dedutivo, envolvendo, ainda, a pesquisa descritiva, explicativa e bibliográfica.
The present work aims to analyze the current situation of the Brazilian prison system, as well as the violation of the fundamental rights of the prisoners. Brazilian criminal law is considered exemplary by some countries, however, when analyzing the current situation of the Brazilian prison system, there is a serious disregard for the rights guaranteed by the Federal Constitution. In this sense, in view of the current situation, it is understood the need to foster education as one of the attitudes to be taken by the State, aiming at reducing the prison population. In the approach, the deductive method was used, also involving the descriptive, explanatory and bibliographic research.
