Este artigo examina a crescente judicialização das eleições no Brasil, com uma análise especial das eleições municipais, evidenciando-se como a Justiça Eleitoral tem sido mobilizada como ferramenta de disputa política, afastando-se de seu papel fundamentalde assegurar a legalidade e a integridade do processo eleitoral. O estudo do caso da Ação de Impugnação de Registro de Candidatura (AIRC) nº 0600165-41.2024.6.26.0190 ilustra como instrumentos jurídicos podem ser estrategicamente empregados para criar incertezas, deslegitimar adversários e comprometer o princípio da igualdade entre os candidatos. Com base na teoria da democracia deliberativa de Habermas e em uma abordagem interpretativa do Direito Eleitoral, argumenta-se que a legitimidade democrática não decorre apenas do rigor técnico-formal, mas também da promoção da deliberação pública e da responsabilidade democrática. Os resultados sugerem que a racionalidade deliberativa pode servir como referencial normativo para mitigar o uso indevido da judicialização como estratégia política, reforçando a confiança nas instituições e assegurando o direito do eleitor a uma escolha livre e informada.
This article analyses the growing judicialization of municipal elections in Brazil, highlighting how Electoral Justice has been increasingly mobilized as a tool for political disputes, moving away from its fundamental role of ensuring legality and the integrity of the electoral process. The case study of the Action for Challengingthe Registration of Candidacy (AIRC) nº 0600165-41.2024.6.26.0190 illustrates how legal instruments can be strategically employed to create uncertainty, delegitimize opponents, and undermine the principle of equality among candidates. Based on Habermas’s theory of deliberative democracy and an interpretative approach to Electoral Law, it is argued that democratic legitimacy arises not only from technical and formal rigor but also from the promotion of public deliberation and civic responsibility. The findings suggest that deliberative rationality can serve as a normative framework to mitigate the misuse of judicialization as a political strategy, strengthening institutional trust and ensuring the voter’s right to make a free and informed choice.
