A intenção deste estudo é a de analisar a “maternidade biológica” como a protagonista da preservação da espécie humana e da perenização de cada uma das etnias para, nessa linha, oferecer a melhor compreensão das razões em virtude das quais o Direito dá especial amparo ao gênero feminino. Em dimensão diversa, porém não menos importante, o estudo analisa as particularidades da chamada “maternidade afetiva” e aprecia a evolução protetiva que o sistema jurídico lhe tem proporcionado.
The intent of this study is to analyze the "biological motherhood" as the protagonist for the preservation of the human species and the perpetuation of each one of the ethnic groups to, in this line, offer a better understanding of the reasons because of which the law gives special base to the female gender. In a different dimension, but not least, the study analyses the particularities of called “affective motherhood” and enjoy the protective legal system developments it has provided.
