O presente artigo busca analisar como o abandono do marxismo, em especial, de sua crÃtica estrutural à esfera jurÃdica como forma social própria do capitalismo, significou a ruÃna das teorias crÃticas do direito. À luz disto, defendemos, a partir do imprescindÃvel primeiro debate jurÃdico soviético (matriz de uma teoria antinormativista), a retomada da crÃtica marxista conjugada com um projeto polÃtico insurgente para o direito.
This paper aims to analyze how the abandonment of Marxism, especially its structural critique of the legal sphere as social form of capitalism, meant the ruin of critical legal theories. Therefore, we argue, from the essential first Soviet legal debate (matrix of a anti-normativism theory), the return of the marxist critique combined with an insurgent political project to the Law.
